Gewinnspiel Disclaimer und Teilnahmebedingungen
1 Allgemeines
Die Teilnahme am Gewinnspiel auf unserer Website (https://www.pbi-int.com/) oder über die Postkarte, ausgeführt durch PBI Performance Products, Inc. (haftunsgbeschränkt) – im Folgenden “PBI” genannt-, ist nur unter Einbeziehung dieser Teilnahmebedingungen möglich.
2 Teilnahmevoraussetzungen
Teilnehmen können alle natürlichen und geschäftsfähigen Personen mit einem Mindestalter von 18 Jahren. Mitarbeiter*innen von PBI und deren Verwandte sind von der Teilnahme ausgeschlossen. Der Rechtsweg ist ausgeschlossen.
3 Gewinn
Der Preis wird, wie im Gewinnspiel ausgeschrieben, vergeben. Es entscheidet das Los unter Ausschluss des Rechtsweges. Eine Änderung oder Barauszahlung des Preises ist ausgeschlossen. Der/die Gewinner*in wird via E-Mail von uns benachrichtigt. Meldet sich der/die Gewinner*in nicht binnen einer Frist von 72 Stunden, verfällt der Gewinn ersatzlos.
4 Haftung
Schadenersatzansprüche gegenüber PBI, die im Zusammenhang mit dem Gewinnspiel stehen, sind unabhängig vom Rechtsgrund ausgeschlossen, es sei denn, PBI hätte vorsätzlich oder grob fahrlässig gesetzliche Pflichten verletzt. Weiterhin übernimmt PBI keine Garantie dafür, dass unsere Website auf dem jeweiligen Teilnehmerrechner ordnungsgemäß funktionsfähig ist.
5 Datenschutz
PBI gewährt im Rahmen des Gewinnspiels den größtmöglichen datenschutzrechtlichen Standard und beachtet alle diesbezüglich einschlägigen gesetzlichen Bestimmungen. PBI wird keine personenbezogenen Daten an Dritte weiterleiten, es sei denn dies ist nötig um die Preise an den/die Gewinner*in zu versendet. Es werden keine Daten verkauft. PBI speichert die personenbezogenen Daten der jeweiligen Teilnehmer*in ausschließlich zum Zwecke des Gewinnspiels und des Newsletters über MailChimp. Der/Die Teilnehmer*in erklärt hiermit ausdrücklich sein/ihr Einverständnis mit der Speicherung und Verwendung der mitgeteilten personenbezogenen Daten zu dem oben genannten Zweck.
6 Salvatorische Klausel
Sollten einzelne Bestimmungen dieser Teilnahmebedingungen unwirksam sein oder eine Regelungslücke bestehen, berührt dies die Wirksamkeit der übrigen Bestimmungen nicht. An die Stelle der unwirksamen oder fehlenden Bestimmungen tritt eine Bestimmung, welche dem Vertragszweck und den gesetzlichen Bestimmungen am nächsten kommt.
7 Gerichtsstand / anwendbares Recht
Bei Streitigkeiten gilt ausschließlich deutsches Recht. Als Gerichtsstand wird, soweit gesetzlich zulässig, der Sitz der PBI Performance Products, Inc. (haftungsbeschränkt) vereinbart (Donaustauf). Soweit der/die Teilnehmer*in keinen allgemeinen Gerichtsstand in Deutschland hat, oder nach der Teilnahme den Wohnsitz ins Ausland verlegt, wird der Sitz von PBI ebenso als Gerichtsstand vereinbart.
8 Auswahlverfahren
Die Gewinner werden mit einem Zufallsgenerator ausgewählt. Der Rechtsweg ist ausgeschlossen.

Competition Disclaimer and Conditions of Participation
1 General
Participation at the competition on our website (https://www.pbi-int.com/) or through the postcard, carried out by PBI Performance Products, Inc. (limited liability) - hereinafter referred to as "PBI" - is only possible with the inclusion of these conditions of participation.
2 Conditions for participation
Participation is open to all natural persons with legal capacity and a minimum age of 18 years. Employees of PBI and their relatives are excluded from participation. The legal process is excluded.
3 Prize
The prize will be awarded as advertised in the competition. The decision will be made by lot, with no recourse to legal action. A change or cash payment of the prize is excluded. The winner will be notified by us via e-mail. If the winner does not respond within 72 hours, the prize will be forfeited without compensation.
4 Liability
Claims for damages against PBI in connection with the competition are excluded, regardless of the legal basis, unless PBI has intentionally or grossly negligently violated legal obligations. Furthermore, PBI does not guarantee that our website will function properly on the respective participant's computer.
5 Data protection
Within the scope of the competition, PBI guarantees the highest possible standard of data protection and complies with all relevant legal provisions. PBI will not forward any personal data to third parties unless this is necessary to send the prizes to the winner. No data will be sold. PBI stores the personal data of the respective participants exclusively for the purpose of the competition and the newsletter via MailChimp. The participant hereby expressly declares his/her consent to the storage and use of the personal data provided for the above-mentioned purpose.
6 Severability clause
Should individual provisions of these Terms and Conditions of Participation be invalid or a loophole exist, this shall not affect the validity of the remaining provisions. The invalid or missing provision shall be replaced by a provision that comes closest to the purpose of the contract and the legal provisions.
7 Place of jurisdiction / applicable law
In the event of disputes, German law shall apply exclusively. To the extent permitted by law, the place of jurisdiction shall be the registered office of PBI Performance Products, Inc. (limited liability) (Donaustauf). If the participant does not have a general place of jurisdiction in Germany or moves his/her place of residence abroad after participation, the registered office of PBI is also agreed as the place of jurisdiction.
8 Selection procedure
The winners will be selected by a random number generator. The legal process is excluded.
